1. Acceptance of terms
Your access and use of all information on the Home Share for Her website is subject to the following Terms and Conditions.
The following terms and conditions are intended to be clear, transparent, easy to read and to ensure that our service provides a safe platform for everyone to use.
The Homeshare for Her Trust (‘Home Share for Her’, ‘we’, ‘our’, ‘us’) reserves the right to vary, amend or otherwise revise these Terms and Conditions at any time.
Home Share for Her will notify you of any major changes to these Terms and Conditions that may arise, and we recommend you read these terms and conditions each time you access the website as you need to ensure that you are familiar with the latest version of these Terms and Conditions.
By registering as a member of Home Share for Her, you agree to be bound by these Terms and Conditions.
2. Description of services
Home Share for Her is a service for women members to register in order to either express an interest in finding a home to live in (known as a Home Seeker) or to express interest in offering a home to live in (known as a Home Owner). Our service will then aim to connect you with other women who may be a potential match for what you are seeking.
As a registered member, you are solely responsible for making your own decisions about any fellow registered member that you meet via Home Share for Her.
You are entirely responsible for making any decisions about the suitability of a suggested match to another member and with regard to suitability the accommodation environment on offer.
Home Share for Her gives no warranty to registered members that the accommodation and/or proposed match selected will have a successful outcome.
3. Users of the website
All registered members of the Home Share for Her will need to be 18 years and older and identify as women. To complete your registration as a member of Home Share for Her, you must sign up on our website and complete the sign up forms. The Services are free for registered members.
You agree and understand that from time to time either the website or the Services may be discontinued for a period of time while amendments, repairs or maintenance are undertaken.
4. Your obligation as a member
As a registered member of Home Share for Her, you will need to provide complete and accurate personal information when registering to use the Services.
Registered members are required to ensure that personal information is true, accurate, not duplicate and complete at all times. You will also ensure no other person uses your account on your behalf.
You must keep communications respectful of other members and the Home Share for Her personnel and you may not enter information on our platform that is unlawful, harassing or harmful.
All information, and communications with Home Share for Her and any information on potential accommodation matches shall be made in good faith.
The Home Share for Her website platform cannot be used by you to promote a service, product or business.
All registered members are required to be active and engaged users of our website and Services. Any inactive accounts, for longer than a 1 year period, will be considered for removal by Home Share for Her.
5. Prohibited uses
In addition to other conditions as set forth in the Terms and Conditions below, you must not use the Home Share for Her website or its content:
- for any purpose that is unlawful;
- to violate any New Zealand laws, or local bylaws or Government mandates;
- to abuse, harm, or discriminate based on gender, religion, ethnicity, disability, age, nationality, or sexual orientation;
- to provide misleading or incorrect information including, but not limited to, a false email address or pretending to be someone other than who you are including using a false identity;
- to corrupt by uploading or transmitting viruses or any other type of malicious code that may be used in any way to affect the functionality and/or operation of our Services or of any other linked websites, or our internet connection;
- to data mine by tracking the personal information of others;
- engage in manipulation to solicit others to perform or participate in any unlawful acts;
- to spam, or phish or any other malicious use of our website platform;
- for any obscene or immoral purpose;
- in any respect tamper with or disable the security features of our website or our Internet connection;
- act in good faith at all times while accessing our website and Services;.
- any breaches of the above will result in the termination of your registration and use of the Home Share for Her Service.
6. Privacy Policy
Use of your information.
The information you provide while registering and to create a membership profile will only be used by us to provide the Services.
Transfer and Storage of Personal Information
All information that you provide to us or is entered into our website or collected from your visiting our website is automatically transferred to servers. When you use our Services, you consent to your personal information being held by our servers as outlined in this document.
The website and Services may be supported by businesses that are outside of your country.
We will not sell or rent your personal information to others. As at the date of this Agreement, our servers are located in New Zealand, hosted by SiteHost. Your personal information will be transmitted through and stored on, those servers as part of the Services. If the servers change in the future, we will update these terms. We would encourage you to frequently review our website so you are aware of any changes. Your personal information may be stored in locations outside the direct control of Home Share for Her.
By providing your personal information to us, you consent to us storing your personal information on servers hosted by SiteHost and accessing your personal information from New Zealand. If your personal information is to be stored on servers located in other countries, it will remain within our effective control at all times. The server host’s role is limited to providing a hosting and storage service to us, and we’ve taken steps to ensure that our server hosts do not have access to, and use the necessary level of protection for, your personal information.
If you are not comfortable with your personal information being transferred to a server in another jurisdiction, you should not provide us with your personal information or use our website or mobile application.
Home Share for Her will have systems in place to protect your information and to protect your information from loss, misuse or any other form of modification.
Although we have systems in place to protect your information, we do not guarantee the security of your information and any information supplied by you is at your own risk. You should only give out your personal information to the website within a secure environment. If we become aware of any security breach relating to your personal information, we will advise you as soon as we can.
Errors, access, accuracy or omissions
Website content uploaded by Home Share for Her, may, on occasion have an error or an omission and should this circumstance arise, Home Share for Her reserves the right to correct the information as soon as practicable.
It is the responsibility of registered members to ensure that the information they have supplied to Home Share for Her is complete and accurate at all times. Home Share for Her does not take responsibility for any inaccuracies in member’s information provided by the member.
Unless there are certain legal grounds for refusing, you may ask to access the personal information we have that is readily available. You may also ask us to update or correct any information we have about you. This may be done by requesting in writing and sending it to us by email to hello@homeshareforher.nz. You will need to prove that you are the individual to whom the personal information relates.
We will process your request as soon as reasonably practicable, unless there are legal grounds preventing us from doing so. We will explain why if we are unable to do so. One example for refusal would be if access would unreasonably impact the privacy of another individual. If you request a correction and we have to refuse, reasonable steps will be taken to note down that you requested that correction.
If appropriate and reasonable, we may charge you the cost of providing and/or correcting your personal information.
Your personal information will only be kept for as long as it is needed. There may be circumstances however where we have to keep the information for a specified amount of time to meet various legal and reporting requirements.
Non-personally Identifiable Data
When you use our Services, you are agreeing to us accessing, aggregating and using non-personally identifiable data collected from you. This data does not identify you nor any other individual.
This data may be used to:
- help us understand how our members are engaging with our Services and website, for example, the busiest days of the month, quantity and timing of membership applications and most popular web pages;
- provide our members with further information regarding the uses and benefits of our Services;
- increase business productivity as the aggregated data can provide relevant business insights; and
- otherwise improve our website and Services.
Privacy Complaints Process
If you are unhappy with how we have handled your personal information, you may send a complaint. Please provide us with the full details of your complaint along with any supporting documentation:

We will:
- Send you an initial response to your query or complaint within ten (10) business days; and
- Look into and seek to resolve the issue within twenty (20) business days. If necessary, we may need a longer period to do this but will notify you of this delay.
7. Passwords and logins
Your password and log on must be kept secure and confidential by you. You must notify Home Share for Her if you think your security has been breached.
8. Rights to content
When you create or amend a membership profile with Home Share for Her, you are producing ‘content’ which is stored privately on our website. Each time you create or amend your membership content, you are agreeing to abide by these Terms and Conditions.
Each time you create or amend membership content, you confirm that you are the owner of the content and its intellectual property rights. You also confirm that you have the permission, or consent of other people referenced or appearing in your content to do so on their behalf e.g children or other adults.
In addition, you confirm that content created by you does not contravene any prohibited uses listed in section 5.
9. Suspension or removal of your membership
Home Share for Her has the right to suspend or terminate your membership if you breach these Terms and Conditions, or in the opinion of Home Share for Her, your use of the Services is posing as a risk to Home Share for Her in terms of a potential breach of New Zealand Law.
10. No advice
Home Share for Her has a member resources section and provides useful guides on various topics. These are intended for general reading purposes only and should not be treated as advice offered specifically to you by Home Share for Her. It is recommended that for your particular set of circumstances that you use registered professionals for legal, property or accounting advice, including the New Zealand Tenancy Service.
11. Tenancy using accommodation agreements
Any proposed accommodation sharing agreement must be legal under New Zealand law. By using the Home Share for Her Services, you agree not to sub-let any accommodation secured.
You are solely responsible for doing your own due diligence checks prior to signing any accommodation agreement and Home Share for Her takes no responsibility whatsoever for the success, legality or otherwise of any proposed accommodation agreements.
12. Limitation of liability
You understand that you use the Home Share for Her Services and its website solely at your own risk.
13. Indemnification
You agree to indemnify and hold harmless Home Share for Her and its Trustees, employees, contractors and agents and agree to keep them indemnified, from any loss, claim or damages suffered, incurred or bought against any one or more of them by a third party as a result of any breach of these Terms and Conditions by you, or the use of our website by you, or the use of our Services by you, any violation of a law by you and any violation of the rights of a third party by you.
14. Disputes
If a dispute arises between us about interpreting or implementing the provisions of these Terms and Conditions, then we will use all reasonable endeavours to resolve the dispute by negotiation in good faith. The parties will attend at least one meeting to discuss an attempt to resolve the dispute as a condition precedent to taking other steps concerning the dispute (including but not limited to commencing any legal proceedings other than an application for injunctive relief).
If the dispute cannot be resolved by negotiation within 5 working days after the dispute arose, the parties will refer the dispute to mediation by a mediator jointly appointed by them. If the parties cannot agree on a mediator and a process for mediation within 10 working days of a request by one to the other to attend mediation, the parties must mediate the dispute in accordance with the Mediation Protocol of the Arbitrators’ and Mediators’ Institute of NZ Inc or its successor, and that organisation will select the mediator and determine the mediator’s compensation.
If the dispute is not resolved within 5 working days of its reference to mediation, then the parties will refer the dispute to arbitration by a single arbitrator agreed on by all the parties to the dispute or, failing agreement the appointment of the arbitrator will be made by the President (or equivalent officer) or his or her nominee for the time being of the New Zealand Institute of Arbitrators. Arbitration costs will be apportioned between the parties in a manner determined by the arbitrator.
15. Severability
If any clause in these Terms and conditions is found to not be entirely enforceable by law, the intention of such a clause shall be enforceable to the fullest extent possible by applicable law and the unenforceable aspect of the clause in question shall be deemed to be severed or removed from these Terms and Conditions while not impacting the remaining clauses in these Terms and Conditions.
16. Intellectual property, copyright and trade marks
Home Share for Her exercises the right of copyright to all aspects of our website and our Services; including all logos, forms, graphics and text (otherwise known as ‘Content’) because they are either owned by us or we have the right to use them.
You are prohibited from using any of our content without our written permission.
17. Links to external websites
Home Share for Her may on occasion provide links to other websites or services, on our website. We do so with the intention to link members to other sources of useful information. However we take no responsibility for the content on these other websites or services, as these external parties have their own Terms and Conditions and privacy policies. You acknowledge that Home Share for Her does not operate these websites or services, and is in no manner responsible or liable for your use or any loss incurred while using these websites or services.
18. Updates to our website and terms
From time to time, we reserve the right to make changes to these Terms and Conditions and our website or to withdraw our website without the need to inform you.
The amended Terms and Conditions will be considered effective as soon as they are posted to this website. If you continue to access and use our website and/or receive our Services, you will be considered to have accepted the amended Terms and Conditions.
19. Relationship
By agreeing to these Terms and Conditions you become an end user of the Home Share for Her Services. You may not represent Home Share for Her nor are you in partnership with nor in joint venture with the Home Share for Her Services.
20. Entire agreement
By agreeing to these Terms and Conditions, you agree that they are whole and complete and supersede any other earlier forms of communication between yourself and Home Share for Her.
21. Governing Law
These Terms and Conditions are governed by, and shall be construed in accordance with, the laws of New Zealand. Both parties submit to the exclusive jurisdiction of the New Zealand Courts.
